Writ seeks stay on Menon’s oath-taking

Dhaka: A writ petition was filed with the High Court on Tuesday seeking its directives to the authorities concerned not to publish gazette on and administer oath to Workers Party President Rashed Khan Menon who won Sunday’s election from Dhaka-8 constituency.

Eunus Ali Akondo, a Supreme Court lawyer and also the Jatiya Party candidate for the parliamentary seat, filed the writ petition, reports the UNB.

The writ also sought the issuance of a rule asking the government to explain as to why the announcement of the results declaring Menon victorious in the Dhaka-8 constituency should not be declared illegal.

At the same time, it also sought directives to postpone the publication of gazette and oath-taking ceremony for the Workers Party president.

Seven persons, including the Chief Election Commissioner, Speaker of the Jatiya Sangsad, Law Secretary, Dhaka Divisional Returning Officer, Rashed Khan Menon and President’s Office Secretary, were made respondents to the rule.

Eunus Ali alleged that the supporters of Menon stuffed ballot boxes, depriving genuine voters of casting their votes. “I lodged complaint with the Election Commission but they didn’t pay any heed to it which violated section 66 of the Constitution.”

Besides, Menon contested the polls holding a profitable post which is also a violation of section 20 of the Representation of the People Order.

The HC bench of Justice Syed Refaat Ahmed and Justice Md Iqbal Kabir is likely to hear the petition on Wednesday.

Menon, a Grand Alliance candidate, was unofficially elected from Dhaka-8 constituency securing 139,538 votes while his nearest rival Mirza Abbas of BNP got 38,717 votes.
