Dhaka: The Supreme Court (SC) Appellate Division gave ‘no order’ on BNP-chairperson’s adviser Abdul Awal Mintoo’s review petition against the High Court order that rejected his writ petition challenging the cancellation of his nomination paper for the mayoral race in the upcoming Dhaka North City Corporation (DNCC) polls.

A four-member bench of the Appellate Division, headed by chief Justice Surendra Kumar Sinha, gave the ‘no order’ on the review petition on Thursday.

Attorney General Mahbubey Alam said with the rejection of Mintoo’s review petition, his nomination paper has remained cancelled.

The other members are Justice Nazmun Ara Sultana, Justice Hasan Faiz Siddique and Justice Sayed Mahmud Hossain.

BNP-backed candidate of DNCC polls Abdul Awal Mintoo filed the review petition with the Supreme Court on Tuesday against the High Court order that rejected his writ petition challenging the cancellation of his nomination paper for the mayoral race in the upcoming DNCC polls.

Chamber Judge of the Appellate Division Justice Hasan Faiz Siddique had fixed Thursday for hearing the appeal.

The High Court on Monday rejected the writ petition filed by Mintoo challenging the cancellation of his nomination paper.

An HC bench comprising Justice Farah Mahbub and Justice Kazi Mohammad Izharul Haq Akand passed the order.

Earlier on Sunday, Mintoo’s counsel filed the writ with the High Court challenging the cancellation of his nomination paper after the Dhaka Divisional Commissioner, also the Appellate Authority, upheld the Election Commission’s decision declaring invalid the nomination paper of Mintoo.

On 1 April, the returning officer of the DNCC election rejected two mayoral nomination papers, including that of Mintoo, during scrutiny.

DNCC returning officer Shah Alam turned down the nomination paper of Mintoo for procedural flaws as the person who seconded his nomination is not a voter of the DNCC.

On 2 April, Mintoo appealed to the divisional commissioner seeking validity of his nomination allowing him to correct their mistakes for contesting the Dhaka North City Corporation polls slated for 28 April.
